Sexual assault with males under the new BNS (Bharatiya Nyaya Sanhita) Jurisprudence and remedies


1. Introduction


Anyone can be sexually assaulted, no matter what their gender is. The Bharatiya Nyaya Sanhita, 2023 (BNS) deals with crimes against women and children, but male survivors find no mention when it comes to sexual assault against them, however, they also need respect and help.


2. Understanding Sexual Assault


Before we talk about the law, it's important to know what sexual assault is. Men and boys who face sexual assault may have different problems because of what society thinks. They may feel ashamed, unsure, and confused about how their body reacted during the assault.


3. Legal Provisions in the BNS


The BNS, focuses on "offenses against women and children."


Sadly, it does not have clear rules for male victims. The BNS does not have the Indian Penal Code (IPC) Section 377, which used to protect men from sexual acts without consent.


But, do remember that if a male person is hurt, killed, or attacked during the sexual assault, they can still get justice under Section 103 BNS (murder), Section 115 BNS (voluntarily causing hurt), Section 117 BNS (voluntary causing grievous hurt) and Section 131 BNS (Punishment for causing assault or criminal force.)


4. Immediate Steps for Male Survivors


If you are a male survivor of sexual assault, think about doing these things:


- Seek Medical Attention: Go to a doctor or a nurse for physical and emotional help.


- Report to Authorities: Make a police report as soon as possible under the sections mentioned above if they apply to your case.


- Counseling and Support: Contact helplines, NGOs, or mental health experts. You are not alone.


5. Coping Strategies and Recovery


Male survivors may feel anxious, sad, and stressed after the assault. Get therapy, join support groups, and take care of yourself.


6. Addressing Stereotypes


Don't let harmful stereotypes make you feel like you should have been "strong enough" to stop the assault. Remember that your body physiology (like erections) does not mean you consented.


7. Conclusion


The BNS needs to be reformed for better in this aspect, but male victims need to be seen, helped, and cared for.
