Introduction
In this article, we will be focussing on the pin-pointed differences between robbery and dacoity under Bharatiya Nyaya Sanhita, 2023 (BNS)
It should be noted that robbery is dealt with under Section 309 of Bharatiya Nyaya Sanhita, 2023 (BNS) and dacoity is dealt with under Section 310 of Bharatiya Nyaya Sanhita, 2023 (BNS).
Difference between robbery and extortion
1. Number of Offenders:
- Robbery: Can be committed by an individual or a group; the number of perpetrators is not a decisive factor.
- Dacoity: Requires the involvement of five or more persons acting together.
2. Nature of Force:
- Robbery: The force or threat is directed towards the victim.
- Dacoity: The force or threat is collectively applied by the group of offenders and can extend to anyone present at the scene.
3. Degree of Organization:
- Robbery: Can be committed by an individual or a group, representing a less organized criminal effort.
- Dacoity: Requires a higher degree of organization and coordination due to the involvement of five or more individuals.
4. Criminal Intent:
- Robbery: The primary intent is to commit theft with the use of force or threat.
- Dacoity: An aggravated form of robbery, dacoity indicates a more serious and organized criminal intent.
5. Legal Consequences:
- Robbery: Punishable under the BNS, with severity based on factors such as the degree of force, injuries caused, and the presence of arms. The maximum punishment for committing robbery under Section 309 of BNS can extend to 14 years.
- Dacoity: Also punishable under the BNS, with more severe punishments due to its organized and collective nature. The maximum punishment for committing dacoity under Section 310 of BNS can extend to 14 years.
